Terms of Sale

These terms apply to orders in the online store po-na.com. By placing an order the buyer confirms that they have read these terms.

1. Seller

Slidena Grida Osaühing, registry code 17633643, registered address: Endla tn 61, Tallinn, Harju maakond, 10615, Estonia. Contact: [email protected]. The seller is established and operates in Estonia (the merchant country for card payments).

2. Goods

The store sells merchandise of the YouTube channel «Пожилой навал»: clothing, key rings and patches. Photos and colours on screen may differ slightly from the real goods. Embroidery is made on the item; the look of threads and fabric depends on the batch. Items are made to order.

3. Order and conclusion of the contract

1. The buyer puts goods in the cart and enters the recipient's details.
2. The buyer pays on the checkout page, after ticking that they have read these terms, the returns terms and the privacy policy.
3. The seller sends an email with the order number and contents to the buyer. From that moment the sales contract is concluded.

If the buyer chooses to pay in cryptocurrency, the order is taken as a request. The seller sends a payment link to the given email and the contract is concluded when payment is received. An unpaid request may be cancelled by the seller.

The seller may refuse to perform or cancel an order if the goods are out of stock or the price contains an obvious error. In that case the seller refunds the whole amount paid. The buyer is responsible for the correctness of the delivery details: name, phone and address.

4. Prices and payment

Prices are in euros and are final prices. The seller is not a VAT payer, so no VAT is included in the price or added to it. The delivery cost is shown before payment and is included in the order total.

Card, Apple Pay and Google Pay payments go through a certified payment provider (PCI DSS). Card details are sent directly to the provider and never reach the seller. Visa and Mastercard cards are accepted. For some payments the bank may ask for 3-D Secure confirmation. For questions about a payment or a charge please write to [email protected] first, it is usually faster than a bank dispute.

5. Delivery

Countries, costs and times are described on the page Delivery and payment. Inside the EU there are no additional charges; for delivery outside the EU, import duties, taxes and customs fees are set and collected by the buyer's country on receipt and are not included in the order price. The risk of accidental loss or damage passes to the buyer on receipt of the parcel. The buyer should check the parcel on receipt and report damage to the seller as soon as possible.

The seller does not deliver to countries and territories under comprehensive international sanctions or embargo (currently Cuba, Iran, North Korea, Syria and the Crimea, Donetsk and Luhansk regions of Ukraine) or to any other place where delivery would breach EU or UN sanctions. Such orders are cancelled and the payment is refunded.

The seller delivers the order within the time shown at checkout or, if none is shown, no later than 30 days after the contract is concluded. If this time is missed, the buyer may set an additional period and then withdraw from the contract.

6. Right of withdrawal

A consumer may withdraw from the contract within 14 days after receiving the goods without giving a reason. See Returns and Withdrawal.

7. Defects and legal guarantee

The seller is liable for the goods being in conformity with the contract for two years from receipt. If the goods are defective or do not match the description, the consumer may require repair, replacement, a proportionate price reduction or a refund as provided by law.

To make a complaint write to [email protected] with the order number, a description of the problem and photos. The seller answers within the time set by law. Normal wear, fading from UV light and damage from improper care (washing against the instructions, bleaching and similar) are not covered.

8. Intellectual property

The name «ПО НА», the logo, designs, texts and photographs on the site belong to the seller or lawful rights holders. Copying, distributing or commercial use without consent is not allowed. Visa and Mastercard are trademarks of their owners.

9. Liability

Liability of the parties is determined by law. Nothing in these terms limits consumer rights that cannot be limited by contract.

10. Personal data

How the seller processes data is described in the Privacy Policy. Use of browser storage is described in Cookies.

11. Governing law and disputes

The contract is governed by Estonian law. A consumer living in another EU country keeps the protection given by the mandatory law of their country. The seller aims to settle disputes by correspondence at [email protected]. The buyer may also contact the Estonian Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet, www.ttja.ee), the Consumer Disputes Committee (Tarbijavaidluste komisjon, komisjon.ee) or a court.

12. Changes

The seller may change these terms. The new version applies to orders placed after it is published.
